1. Introduction

Welcome to Affilify (“we”, “us”, “our”, “the platform”). By accessing or using Affilify, you agree to be bound by these Terms & Conditions (“Terms”).

Affilify operates as:

A marketplace directory where businesses can list affiliate programs.
A platform for affiliates to discover and join programs.
A Done-For-You (“DFY”) service provider for businesses that request affiliate program setup.

If you do not agree with these Terms, you must not use Affilify.

2. Platform Nature & Role Disclaimer

Affilify is a platform and marketplace only. We are not a product owner, merchant, or employer of affiliates. We do not control, manage, or guarantee:

Payments of commissions or fees.
Tracking systems, cookies, or links used by businesses.
The accuracy of affiliate program information provided by businesses.
The performance, income, or results of any affiliate program.

Affilify is not:

A payment processor or payout provider.
An affiliate tracking platform.
Financially responsible for any commissions owed to affiliates.
Legally responsible for third-party business activity or conduct.

All financial transactions, tracking, and commission payments are the responsibility of the business (merchant) offering the affiliate program.

3. Eligibility

By using Affilify, you confirm that you:

Are at least 16 years old, or the age of majority in your jurisdiction.
Have the authority to enter into a binding agreement.
Will provide accurate and truthful information.
Will not use the platform for illegal, abusive, or fraudulent purposes.

Businesses listing programs are responsible for ensuring that:

They own or are authorised to promote the products or services they list.
Their affiliate program is legally compliant and accurately represented.
They comply with advertising, consumer, and data protection laws in their region.

4. Affiliate Accounts

If you use Affilify as an affiliate, you understand and agree that:

Joining affiliate programs listed on Affilify is generally free of charge.
Acceptance into any program is not guaranteed and is decided by the business.
Any commissions earned are paid by the business, not by Affilify.
Tracking accuracy, cookies, and attribution are controlled by the business or its tools.
Affilify is not liable for missed, delayed, reversed, or incorrect payments.

Affiliates agree to:

Follow all applicable advertising and disclosure regulations (including marking promotions as ads where required).
Not engage in spam, misleading claims, or unethical marketing.
Respect each business’s individual rules and promotional guidelines.

5. Business Accounts & Program Listings

If you list an affiliate program on Affilify as a business, you agree that:

You are solely responsible for tracking referrals and paying affiliates correctly and on time.
Affilify does not process, manage, or distribute affiliate payments.
All information you provide (commission rates, terms, eligibility, etc.) is accurate and kept up to date.
You will honour publicly stated payout structures, terms, and conditions.
You will handle any disputes with affiliates directly.

Affilify reserves the right to reject, edit, suspend, or remove any program listing at any time, including (but not limited to) when:

Verified complaints are received about missing or unfair payments.
Programs appear misleading, unethical, or illegal.
Information is found to be false or deliberately incomplete.
Affiliates are repeatedly dissatisfied or harmed by the program’s behaviour.

6. Marketplace Listing Fees (Basic & Featured)

Affilify may charge businesses a fee for listing affiliate programs, such as:

Basic Listing – typically £19/month.
Featured Listing – typically £49/month.

By subscribing to a listing:

You agree to recurring charges according to the plan selected.
You acknowledge that suspension or removal of your listing does not automatically entitle you to a refund.
All billing and payment details must be accurate and kept up to date.

Affilify may update or change pricing and plans at any time, with reasonable notice.

7. Done-For-You (DFY) Service Terms

Businesses may request an optional DFY setup service, where Affilify assists in creating or structuring an affiliate program. By using this service, you agree that:

DFY pricing typically starts from £350, depending on scope and complexity.
Payment terms will be agreed before work begins and are generally non-refundable once work has started.
The DFY service focuses on strategy, structure, and setup — not guaranteed sales or performance outcomes.
Affilify is not responsible for the long-term management, recruitment, or payment of affiliates.

Affilify may decline or terminate DFY services at its sole discretion.

8. Platform Content & Accuracy

While Affilify aims to provide useful and accurate information, we do not warrant that:

All program information is complete, accurate, or up to date.
Any specific program is legitimate, profitable, or suitable for your goals.
Information displayed on the platform is free from errors, omissions, or changes made by third parties.

Users agree to perform their own due diligence before joining or listing any program.

9. User Conduct

You agree not to use Affilify to:

Send spam, unsolicited messages, or bulk outreach in violation of anti-spam laws.
Post misleading, fraudulent, defamatory, or harmful content.
Engage in harassment, abuse, or threatening behaviour.
Copy, scrape, or misuse data from the platform without permission.
Exploit security vulnerabilities or attempt to gain unauthorised access.

Affilify may suspend or terminate access if we believe you are misusing the platform or violating these rules.

10. Intellectual Property

All Affilify branding, design, layout, graphics, and platform content (excluding user-submitted listings) are owned or licensed by Affilify.

You may not:

Copy or replicate the platform design or functionality.
Use Affilify logos, brand names, or trademarks without written permission.
Redistribute or resell access to the platform or its data.

11. Limitation of Liability

To the fullest extent permitted by law, Affilify and its owners, employees, and partners shall not be liable for any:

Loss of income, profits, or business opportunities.
Missed, delayed, incorrect, or disputed commission payments.
Indirect, incidental, or consequential damages.
Issues caused by third-party tools, tracking platforms, or services.
Website downtime, bugs, or technical issues.

You use Affilify entirely at your own risk.

12. No Guarantees

Affilify does not guarantee:

Acceptance into any affiliate program.
Any level of earnings, performance, or results.
Specific traffic, exposure, or sign-ups for listed programs.
That any program or relationship formed through the platform will continue.

All income examples, performance references, or testimonials are illustrative and not a promise of results.

13. Termination

Affilify may suspend, restrict, or terminate your access to the platform at any time, with or without notice, including if:

We suspect fraud, abuse, or violation of these Terms.
You provide false, misleading, or incomplete information.
Your use of the platform harms Affilify, its users, or its reputation.

You may stop using Affilify at any time. Any outstanding payment obligations or responsibilities will survive termination.

14. Refund Policy

Due to the nature of digital listings and DFY services:

Listing fees (Basic or Featured) are generally non-refundable once the listing period starts.
DFY setup fees are non-refundable once work has begun.

Any exceptions or goodwill refunds are at the sole discretion of Affilify.

15. Privacy & Data

Affilify collects and stores limited information such as:

Contact details submitted via forms.
Program details provided by businesses.
Basic analytics and usage data.

By using the platform, you agree that:

We may share submitted details with relevant businesses or affiliates when you explicitly opt in or apply.
We will not sell your personal data to third parties.

16. Dispute Handling

Any disputes regarding commissions, payments, tracking, or program terms are strictly between the affiliate and the business.

Affilify may, at its discretion, review complaints and take action such as warning, suspending, or removing a listing, but is not obligated to resolve disputes or compensate any party.

17. Changes to These Terms

Affilify may update these Terms from time to time. When changes are made, we will update the “last updated” date or provide notice where appropriate.

Continued use of the platform after changes are posted constitutes your acceptance of the updated Terms.
