2. Services Provided

Affilify provides AI-powered inbound communication and automation services, including but not limited to:

• AI SMS automation
• AI WhatsApp automation
• AI Instagram messaging automation
• AI Facebook messaging automation
• Lead qualification and appointment booking support
• Customer communication workflows and automations

We reserve the right to update, improve, modify, or discontinue any part of our services at any time.

3. Eligibility

By using our services, you confirm that you are at least 18 years old and legally able to enter into binding agreements.

4. Payments & Billing

Unless stated otherwise in writing:

• All plans are billed monthly
• Prices are displayed in GBP (£)
• Payments are due in advance of each billing cycle
• Failure to pay may result in suspension or termination of services

Example pricing may include:

• £295/month – AI Inbound Agent
• £495/month – Multi-Channel AI Agent

We reserve the right to update pricing at any time with reasonable notice.

5. Setup & Delivery

Delivery times may vary depending on the complexity of the setup, availability of required information, third-party platforms, and the responsiveness of the client. Any timelines given are estimates only.

6. No Guarantee of Results

While our services are designed to help improve response speed, lead handling, and operational efficiency, we do not guarantee specific business outcomes, revenues, conversion rates, appointment volumes, or customer results.

Results depend on many external factors, including but not limited to offer quality, pricing, lead source, customer demand, business operations, follow-up speed, and sales performance.

7. Client Responsibilities

By using our services, you agree to:

• Provide accurate and up-to-date business information
• Ensure your business operations comply with applicable laws and regulations
• Review any outputs, responses, and automations before relying on them fully
• Respond to leads, bookings, or escalations where required
• Not use our services for misleading, harmful, unlawful, or abusive purposes

8. AI Limitations

AI systems may occasionally produce incorrect, incomplete, delayed, or unsuitable responses. You acknowledge that AI outputs are not perfect and may require monitoring, review, or manual intervention.

Our AI services should not be used as a substitute for professional legal, medical, financial, or regulated advice.

9. Third-Party Platforms

Our services may rely on third-party platforms, tools, and providers, including CRM systems, messaging tools, Meta platforms, WhatsApp, Shopify, GoHighLevel, SMS providers, and other integrations.

We are not responsible for outages, delays, policy changes, suspensions, limitations, or errors caused by third-party services.

10. Cancellation & Termination

You may cancel your service before your next billing cycle. Unless otherwise agreed in writing:

• No refunds are provided for partial billing periods
• Access to services may end at the end of the paid billing period
• We may suspend or terminate services for non-payment, abuse, or breach of these Terms

11. Refund Policy

Due to the digital and service-based nature of our offering, fees are generally non-refundable once services, setup, or access have been provided, unless otherwise agreed in writing.

12. Intellectual Property

All branding, systems, workflows, copy, content, materials, and intellectual property created by or owned by Affilify remain our property unless explicitly agreed otherwise in writing.

You may not copy, reproduce, resell, distribute, or exploit our materials without permission.

13. Limitation of Liability

To the maximum extent permitted by law, Affilify shall not be liable for:

• Loss of profits, revenue, customers, or opportunities
• Indirect, incidental, or consequential damages
• Business interruption or system downtime
• Third-party platform failures or restrictions
• Decisions made by you based on AI-generated outputs

14. Indemnity

You agree to indemnify and hold Affilify harmless from claims, liabilities, losses, damages, costs, and expenses resulting from your misuse of our services, your business activities, or your breach of these Terms.

15. Changes to Terms

We may update these Terms from time to time. Continued use of our services after updates are made constitutes acceptance of the revised Terms.

Affiliate Program Terms

16. Affiliate Eligibility

To participate in the Affilify affiliate program, you must be at least 18 years old and provide accurate account information. We reserve the right to approve or reject any affiliate application at our sole discretion.

17. Commissions

Affiliates may earn commission for successful referrals in accordance with the commission structure published or agreed at the time.

• Commission is only due on valid, successful, paid referrals
• Commission rates may be changed at any time with notice
• No commission is owed on fraudulent, cancelled, refunded, or unpaid purchases

18. Payout Terms

Affiliate payouts may be made monthly or on another stated schedule. We may apply a minimum payout threshold. We reserve the right to delay or withhold payouts where fraud, abuse, chargebacks, or policy violations are suspected.

19. Acceptable Promotion

Affiliates may promote Affilify using ethical and lawful methods. You must not:

• Spam emails, DMs, texts, or comments
• Misrepresent Affilify, its results, or its services
• Use false scarcity, misleading claims, or fake testimonials
• Run paid ads on our branded terms without permission
• Impersonate Affilify or present yourself as an employee unless authorised
• Use deceptive, unlawful, or harmful promotion methods

20. Tracking & Attribution

Referrals may be tracked through unique links, cookies, coupon codes, or other systems. We are not responsible for missed or lost tracking caused by user behaviour, browser settings, third-party tools, or technical issues outside our control.

21. Affiliate Termination

We reserve the right to suspend or terminate any affiliate account at any time, with or without notice, if we believe an affiliate has violated these Terms, acted dishonestly, or harmed our brand.
